Terms of Sale and Use

These Terms of Sale and Use ("Terms") apply to your use of getpeppytides.com (the "Site") and to any purchase of products from PeppyTides ("PeppyTides," "we," "us" or "our"). By using the Site, submitting an inquiry or placing an order, you agree to these Terms. If you do not agree, do not use the Site or buy our products.

1. Research use only

All products sold by PeppyTides, including lyophilized peptides and bacteriostatic water (the "Products"), are sold strictly for in-vitro laboratory research and educational purposes only.

  • Products are not for human or animal consumption, injection, ingestion, inhalation or application of any kind.
  • Products are not drugs, food, dietary supplements, cosmetics or medical devices. They have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) or any other agency to diagnose, treat, cure, mitigate or prevent any disease or condition.
  • Products must not be used in humans or animals, in clinical settings, or for any diagnostic or therapeutic purpose.
  • Products must not be resold, relabeled or repackaged for human or animal use.

Any use of a Product outside of lawful laboratory research is a violation of these Terms. We may refuse or cancel any order, and stop doing business with any buyer, if we believe a Product may be used for human or animal consumption or any other prohibited purpose.

2. Age and eligibility

You must be at least 21 years old to use the Site or buy Products. By using the Site or ordering, you confirm that you are 21 or older and legally able to enter into a binding contract. We may ask for proof of age or identity at any time and may cancel any order if it is not provided.

We sell and ship only to addresses in the 50 United States. We do not ship internationally. Even within the United States, you are solely responsible for knowing and complying with all federal, state and local laws that apply to purchasing, receiving and possessing the Products where you are. 3. Buyer representations

By submitting an inquiry or placing an order, you represent and warrant that:

  1. You are at least 21 years old.
  2. You are purchasing Products only for lawful laboratory research, and you (or the institution or business you represent) are qualified to handle, store and use research chemicals safely.
  3. You will not use, or allow anyone else to use, any Product in or on humans or animals, or for any diagnostic, therapeutic, food, supplement or cosmetic purpose.
  4. You will handle, store and dispose of Products in accordance with all applicable laws, regulations and accepted laboratory safety practices.
  5. Purchasing, receiving and possessing the Products is lawful where you are located, and you are solely responsible for knowing and complying with those laws.
  6. The information you give us (including your name, contact and shipping details) is accurate and complete.

If any of these statements is untrue, we may cancel your order without liability, and you agree to the indemnity in Section 7.

4. No medical advice and no health claims

Nothing on the Site, in our emails, on our labels or in any other communication from us is medical, health, dosing or usage advice. Product descriptions, references to published research and any certificates of analysis (COAs) are provided for informational and research purposes only and are not claims that any Product is safe or effective for any use in humans or animals.

We do not provide, and will not respond to requests for, dosing, administration, reconstitution-for-use or other usage guidance for human or animal use. If you have a health question, talk to a licensed medical professional.

5. Orders by inquiry, pricing and payment

Inquiry-based ordering. The Site does not currently offer online checkout. To order, submit an inquiry through the Site's contact form or email hello@getpeppytides.com. We will reply with a quote showing availability, price, shipping and how to pay.

Order acceptance. An inquiry is not an order, and a quote is not a guarantee of availability. A contract of sale is formed only when we confirm your order in writing and receive full payment. We may decline or cancel any inquiry or order for any reason, including suspected prohibited use, incomplete or inaccurate information, pricing or listing errors, or stock limits. If we cancel an order you have already paid for, we will refund the amount you paid.

Pricing. Prices are in U.S. dollars and may change without notice until your order is confirmed. Prices shown on the Site do not include shipping, handling or applicable taxes unless stated. We are not bound by obvious pricing or typographical errors.

Payment. Once we confirm your order, we will email you an invoice. We accept payment by cryptocurrency, Zelle, Venmo, Cash App and Apple Cash. Payment is due in full before an order ships. Invoices are valid for 24 hours. If an invoice is not paid in full within 24 hours of being sent, the order is automatically cancelled. Prices and availability may change if you order again.

These payments are made through third-party apps and networks that we do not own or control. Your use of them is subject to each provider's own terms and privacy policy, and we are not responsible for their services, fees, delays or errors. We do not take payment cards on the Site and we do not store card details. Please follow the payment instructions on your invoice exactly, including any note or reference it asks you to include. Cryptocurrency transactions generally cannot be reversed, so double-check the address, network and amount before sending.

Taxes. Any applicable sales tax will be shown on your invoice.

All sales final. All sales are final. We do not accept returns or exchanges for any reason. Refunds, replacements or credits are available only in the limited cases described in our Shipping & Sales Policy (for example, an order we cancel, an out-of-stock item, a cancellation before shipment, or an approved claim for a damaged, wrong or lost order). Nothing in these Terms limits any right you have that cannot be waived under applicable law.

6. Product information, testing and warranty disclaimer

We try to describe Products accurately. Product images, including vial and label images, are illustrative and may not exactly match the item you receive. Our Products come from multiple vendors. Certificates of analysis (COAs) are available on request: email hello@getpeppytides.com with the product you're asking about. A COA reflects the testing of the batch it covers and is provided for research reference only.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, PRODUCTS ARE SOLD "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that any Product is suitable for any particular research application, and we make no warranty of any kind regarding any use of a Product in humans or animals.

7. Assumption of risk and indemnity

Assumption of risk. Research peptides and related materials can be hazardous if mishandled. You understand and accept that you are solely responsible for the safe handling, storage, use and disposal of all Products, and you assume all risks arising from your purchase, possession and use of them, including any use that violates these Terms.

Indemnity. To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless PeppyTides and its owners, employees, agents, suppliers and affiliates from and against any and all claims, demands, losses, damages, liabilities, penalties, costs and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your purchase, handling, storage, use, misuse, resale or disposal of any Product; (b) any use of a Product in or on humans or animals; (c) your breach of these Terms or of any representation in Section 3; or (d) your violation of any law or the rights of any third party.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • IN NO EVENT WILL PEPPYTIDES OR ITS OWNERS, EMPLOYEES, AGENTS, SUPPLIERS OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, RESEARCH RESULTS OR GOODWILL, OR FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM ANY USE OF A PRODUCT CONTRARY TO THESE TERMS, however caused and under any theory of liability, even if we have been advised of the possibility of such damages.
  • OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

9. Use of the Site

You agree not to misuse the Site, including by attempting to access it without authorization, interfering with its operation, scraping it in bulk, or using it for any unlawful purpose. All content on the Site, including text, graphics, logos and label designs, belongs to PeppyTides or its licensors and may not be copied or reused without our written permission. Links to third-party sites or published research are provided for convenience only; we do not control or endorse them.

10. Governing law and disputes

These Terms and any dispute arising out of or relating to them, the Site or any Product are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. You agree that any such dispute will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

11. Changes, severability and entire agreement

We may update these Terms at any time by posting a revised version on the Site with a new "Last updated" date. The version in effect when your order is confirmed applies to that order. If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and Shipping & Sales Policy, are the entire agreement between you and us about the Site and the Products.
